Why pre-consent cookies are a problem
Under the GDPR and ePrivacy Directive, websites must obtain explicit consent before placing non-essential cookies on a visitor’s device. This means no tracking cookies, analytics cookies, or advertising cookies until the visitor clicks “Accept” on your consent banner.
The Data Protection Commission (DPC) actively enforces cookie consent requirements. While the DPC cannot issue direct fines under the ePrivacy Regulations (SI 336/2011), it can prosecute through the courts and can apply GDPR powers where cookies involve personal data processing.
Common issues include Google Analytics loading on page load, Facebook Pixel firing before consent, and session replay tools like Hotjar recording without permission.
