Why pre-consent cookies are a problem
Under the GDPR and ePrivacy Directive, websites must obtain explicit consent before placing non-essential cookies on a visitor's device. This means no tracking cookies, analytics cookies, or advertising cookies until the visitor clicks "Accept" on your consent banner.
The Dutch Data Protection Authority (Autoriteit Persoonsgegevens) has actively enforced this requirement. Fines for cookie violations have been issued to both large companies and small businesses.
Common violations include Google Analytics loading on page load, Facebook Pixel firing before consent, and session replay tools like Hotjar recording without permission.
